At
the Law Offices of Mark Kotlarsky, we firmly believe that
businesses must fulfill their obligations to customers, suppliers
and workers. Mark Kotlarsky, a Maryland trial lawyer, employment
attorney and worker compensation lawyer, has recovered hundreds
of thousands of dollars for unpaid and underpaid workers in
employment wage disputes.
Under
the law, if an employer “willfully” fails to pay
wages (not due to a mistake), a court can require the employer
to pay two or three times the amount of unpaid wages, plus
attorneys’ fees. The total amount recovered may be many
times the unpaid wages. We recently collected $120,000 on
a $20 thousand unpaid wage claims, $100,000 on a $10 thousand
unpaid minimum wage claim and and $10,000 on a $1,500 unpaid wage claim.
Many
hourly workers are systematically underpaid by their employers.
In fact, undocumented aliens are almost never paid as required
by law. We represent employees (including undocumented aliens)
in lawsuits against their employers for unpaid wages, failure
to pay minimum wage, unpaid overtime and failure to pay prevailing
wages to construction workers. We do not represent employers
in wage disputes.
We
offer free consultations in unpaid wage cases and do not charge
any fees unless we win and collect.
We
also represent clients in various types of small business
disputes and lawsuits: commercial landlord-tenant issues,
partners’ separation, commercial misrepresentations,
Americans with Disabilities Act (“ADA”) compliance,
breaches of contract, etc. Last couple of years, Mark won three commercial
misrepresentation cases, including a $20 million investment
fraud case, secured a large interest abatement from an overzealous
lender, and successfully represented two small store’s
owners in ADA compliance cases.
